General Provisions

These conditions are valid between the company Adige Multiservice S.r.l. (hereinafter referred to as the “Company”), with its registered office in Milazzo (ME), Italy, in Via XX Luglio, 20/22, zip code 98057, C.F. / P.IVA 03788990830, and any natural or legal person (hereinafter referred to as the “Client”) who requests, for himself or for third parties, the provision of services offered on the site www.adigemultiservice.com and/or sites linked to it.

These conditions govern purchases of parking reservation services made on www.adigemultiservice.com – and/or sites linked to it – in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, 206/2005, as amended by Legislative Decree n. 21/2014,  n. 70/2003 on electronic commerce and by the Legislative Decree n. 185/1999 (distance contract) and may be subject to change at any time; the date of publication of the conditions on the site is equivalent to the date of entry into force.

ADIGE MULTISERVICE is a trademark owned by Adige Multiservice S.r.l. and identifies the business branch dedicated to Parking, Transfer and Car Rental services.

Art.1 – Vehicle delivery

The delivery of the vehicle must be made exclusively to an employee of “ADIGE MULTISERVICE”, at one of the dedicated stations, who will fill out the prepared form that will be signed by the customer. The form should include first name, last name, car model, license plate, date and time of arrival, date and time of expected return, the customer’s contact telephone number for any communications, and names of any third parties assigned to pick up the vehicle.

In addition to the above, it is imperative for the customer to indicate on this form the presence of any defects or faults in their vehicle that are not immediately noticeable to the parking attendant. The Company shall in no way be liable for any damage suffered or caused by the Customer’s vehicle as a result of such defects or faults not expressly stated on the form upon delivery and shall also be held harmless by the Customer for any damage caused to third parties.

Art.2 – Return of the vehicle

Return of the vehicle will take place at the ADIGE MULTISERVICE office on the date and time indicated on the above form. The customer is required to call one hour before arrival so the vehicle can be found ready for pickup. In case of changes in the date or time of the customer’s return without prior notice, the company will return the vehicle as soon as possible; any delays of the company itself, occurred as a result of lack of prior notice, will not result in any liability for the Company.

If the name of any third person assigned to collect the vehicle is not indicated on the acceptance form, the vehicle cannot be delivered to that person. The delivery of the vehicle to third parties can only take place by presenting a written proxy containing a copy of the identity documents of the owner of the vehicle and of the person delegated to collect it.

Art.3 – Payment of the service fee

Payment will be made when booking online via PayPal, credit card (Mastercard, Visa, Amex) or bank transfer. In case of payment by bank transfer, the reservation will be considered confirmed only when the payment is actually received in the Company’s bank account.

Art.4 – Hours of service

The service will be made available by the Company every day from 05:30 to 23:00, both weekdays and holidays.

Art.5 – Insurance Coverage

The customer represents and warrants that his or her vehicle is covered by an insurance policy for its full value and releases ADIGE MULTISERVICE S.R.L. from any liability, direct or indirect.

Art.6 – Insurance

Adige Multiservice S.r.l. declares that it is insured with primary insurance company to cover the vehicles entrusted to it.

Art.7 – Delivery fulfilments

As stated above, it is the customer’s obligation to have the receiving personnel ascertain the integrity of the vehicle and point out any defects or damages, ensuring that the same personnel acknowledge them by written statement on the delivery form signed by both the Adige Multiservice S.R.L. Company than by the customer. In this statement, failures, defects, damages and other anomalies of the vehicle entrusted to the Company present at the time of delivery must be indicated in detail.

The ADIGE MULTISERVICE S.R.L. Company shall not in any way be held responsible for faults, defects or damages present on the vehicle not immediately found by simple summary examination of the same at the time of delivery, other than those declared and found at the time of delivery and in any case shall not be held responsible for damages suffered or produced by the vehicle to persons, animals or things due to defects or faults wilfully or culpably concealed and/or hidden by the client, with particular regard to those concerning the engine and mechanical parts in general.

Art.8 – Vehicle Displacement

The customer agrees that his or her vehicle, when booking uncovered parking, will be transferred from the main office to the yard of the company Adige Multiservice S.r.l. and vice versa. During such transfers, the company agrees to take the utmost care of the vehicle, ensuring that this activity will be carried out by experienced personnel to drive the entrusted vehicle.

Where the customer requests maintenance and/or washing of the vehicle, the Company will consider itself authorized to transfer the vehicle to places designated for such activity, committing itself in all cases to take the utmost care of the same and also guaranteeing that such transfer activity will be carried out by personnel experienced in driving the entrusted vehicle.

The Company ADIGE MULTISERVICE S.R.L. shall in no way be held responsible for failures, defects or damages present on the vehicle that are not caused by the Company itself.

Art. 9 – Rates

The rates charged are those in effect at the time of payment and are displayed to the public on the website www.adigemultiservice.com and at the ADIGE MULTISERVICE boxes

Art. 10 – Processing of personal data

The Customer’s data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section of the website www.adigemultiservice.com containing the information pursuant to Art. 13 EU Regulation 2016/679 (Privacy Policy).

Art. 12 – Applicable Law and Jurisdiction

These Conditions shall be governed by and construed in accordance with the laws of Italy, without prejudice to any different overriding mandatory rules of the purchaser’s country of habitual residence. Accordingly, the interpretation, performance and termination of these Terms and Conditions shall be subject exclusively to Italian law.

Any disputes inherent and/or consequent to these Terms and Conditions shall be settled exclusively by the Italian judicial authority. In particular, if the Customer qualifies as a Consumer, any disputes shall be resolved by the court of the Customer’s place of domicile or residence in accordance with applicable law. If the Customer does not qualify as a Consumer, the court of Messina will have jurisdiction for any dispute.

Art. 13 – Express approval

The customer declares, in accordance with art.1341 and 1342 of the Italian Civil Code, to approve and accept all the general conditions listed above from art.1 to art.13.
